This paper explains the urgency and the problematic implementaion of Intellectual Property Rights (IPR) in Indonesia. There is an assumption of some people that the application of intellectual property is to the interests of the capitalism. However, this paper shows that the legal protection of intellectual property rights is in line with the view of Islamic law. Regulatory and legal protection of intellectual property rights of the basics can be found in the Koran, al-Sunnah, and fiqh books of various schools. According to the perspective of Islamic law crime of piracy, including hudud crimes (theft) with certain penalties and may also be classified as ta‘zir crimes with penalties specified by the competent authority.
