This paper aims to see and know the justice system in Afghanistan and the judicial system in Afghanistan. The (secondary) research method is obtained by conducting and reviewing the literature and laws and regulations, the case is related to the subject matter written and through the library research method (literary study). The results of the study show that the Religious Courts in the State of Afghanistan are seen from the data obtained by the researchers and the analysis that the researchers conducted in the Afghan justice system, there are four, namely the Supreme Court, Appellate Court, Civil Court and Municipal Court. Thus, the author's recommendation is that the judiciary in Afghanistan is further strengthened and can classify what can be made into customary law and statutory law so that the law that applies to customary and statutory law does not mix.
