Abstract
The legal system in Indonesia has Islamic law and customary law. Criminal law in Indonesia so far is
based on the Indonesian Penal Code. After Indonesian independence in 1945, it is still in use. in the
scope of criminal law, how about customary law and Islamic criminal law? this existence is
contained in the Criminal Code article 2 paragraph (1) and (2) of the Criminal Code Bill, recognizing
the law that lives in the midst of the community.
